A specialist pharmaceutical and life science exposure

Psilocybin products sit within a specialised area of the Australian life science market. For insurers, the exposure can combine pharmaceutical products liability, unapproved therapeutic goods, controlled-substance handling, product quality, research activity, secure storage, specialist logistics and professional services.

The exact insurance approach depends on the insured entity’s role. An Australian sponsor or importer presents a different risk from a contract manufacturer, research organisation, laboratory, distributor or logistics provider. A clear description of who manufactures the product, who owns or sponsors it, where it is sourced, how it is supplied and the countries involved is therefore important when approaching insurers.

Insurance covers to assess

Public and products liability

Products liability can be a core consideration for an entity that manufactures, imports, sponsors, brands, distributes or supplies a psilocybin product. Insurers will generally want the product and activity described specifically rather than relying on a broad description such as pharmaceutical products or research services.

Controlled substances, unapproved therapeutic goods, clinical use, product efficacy representations and overseas exposures can affect insurer appetite. Exclusions and endorsements should be reviewed carefully because a standard products liability policy should not be assumed to automatically cover psilocybin-related products or activities.

Product recall and contamination

Product recall cover may be relevant where an insured is responsible for a finished therapeutic product, active ingredient or supply-chain component. This is generally separate from standard products liability. Depending on the policy and market, cover may address defined recall costs, withdrawal expenses, replacement costs, third-party recall liability or certain business interruption consequences.

Availability can be limited for specialist pharmaceutical products, so the exact product, manufacturing arrangements, batch controls, testing and recall procedures need to be disclosed to the insurer.

Property, stock and business interruption

Businesses holding psilocybin active ingredient or finished product may require specific consideration of stock values, storage arrangements, security, theft exposure, fire protection, environmental conditions and maximum accumulation at any one location.

Business interruption should be considered alongside the property cover, particularly where replacement stock has a long lead time, specialist manufacture is concentrated at one site or regulatory-sensitive supply arrangements could delay replacement.

Marine cargo and pharmaceutical transit

Imported materials and domestic distribution may require marine cargo or transit insurance. Underwriters can consider packaging, security, transport providers, temperature or environmental controls where applicable, accumulation values, transit territories and the contractual point at which risk transfers between parties.

For controlled or high-value pharmaceutical stock, policy conditions and theft limitations can be particularly important.

Clinical trial insurance

Where a business sponsors or conducts a psilocybin clinical trial, clinical trial liability or no-fault compensation insurance may be required depending on the trial structure, jurisdictions, ethics requirements and contractual arrangements. This is a specialist placement and should be separated from ordinary products liability unless the insurer has expressly agreed otherwise.

Professional indemnity and errors & omissions

Professional indemnity may be relevant where an insured provides research, regulatory-support, quality, consulting, data, laboratory, technical or contract research services. The policy should reflect the services actually performed and the territories in which those services are provided.

Professional indemnity does not replace products liability. Businesses performing both professional services and product-related activities may require a coordinated placement across more than one policy.

Cyber and management liability

Cyber insurance may be relevant where the organisation holds sensitive research, patient, clinical, commercial or intellectual-property information. Management liability may also be considered for private companies with directors, employees and corporate governance exposures. These covers remain subject to the policy wording, exclusions, limits and the insured’s activities.

What insurers are likely to want to understand

Psilocybin-related submissions need to be detailed enough for an underwriter to understand the risk without assumptions. Information commonly requested can include:

  • Full legal entities to be insured and each entity’s role
  • Description of all psilocybin products, ingredients and dosage forms
  • Whether the insured acts as sponsor, manufacturer, importer, distributor, researcher or service provider
  • Manufacturing sites and details of contract manufacturers
  • Quality-control, batch-testing and release procedures
  • Countries of manufacture, import, export and sale
  • Annual and projected turnover by activity and territory
  • Research and clinical trial involvement
  • Storage, security and transit arrangements
  • Maximum stock values and accumulation at any one location or transit
  • Previous product complaints, recalls, adverse incidents or claims
  • Existing policy schedules, wordings and insurer requirements
  • Any new products, markets or activities planned during the policy period

Providing the full supply-chain picture can be particularly important. A business importing finished product from an overseas manufacturer is a different exposure from an entity arranging manufacture under its own specifications, owning the brand, sponsoring the product or supplying through a research program.

Overseas manufacture and international exposure

Psilocybin businesses can involve overseas contract manufacturers, specialist suppliers and international research partners. Insurers may assess where product is manufactured, the quality standards applied, the contractual allocation of responsibilities, sales by country and whether there is any United States or Canadian exposure.

International liability and jurisdiction wording should be checked against the actual business model. An Australian policy should not be assumed to respond to every overseas product, research or contractual exposure.

Common psilocybin insurance questions

Will a standard pharmaceutical products liability policy automatically cover psilocybin?

No assumption should be made. Some insurers may decline the exposure, restrict cover for controlled substances or unapproved therapeutic goods, or require specific underwriting approval. The product and activities should be disclosed expressly and the final wording checked before cover is relied upon.

Can Mercantile insure a psilocybin sponsor or importer?

Potentially, subject to the insurer’s appetite, the insured’s activities, regulatory position, territories, product details and underwriting information. We can present the insurance exposure to specialist markets, but we do not determine whether the proposed activity is legally authorised.

Is clinical trial insurance the same as products liability?

No. They address different exposures and may be written under separate policies. A trial sponsor should not assume its ordinary products liability policy satisfies clinical trial insurance or ethics requirements.

Can product recall be added to a liability policy?

Sometimes limited extensions may be available, but comprehensive product recall is generally a distinct insurance class. The available cover, trigger, limits, deductible and excluded costs should be reviewed separately.
